Comparison of patents and trade secrets as possible ways of protecting intellectual property rights Abstract The thesis Comparison of patents and trade secrets as possible ways of protecting intellectual property rights compares the institutes of patents and trade secrets and highlights their individual positives and negatives. It first addresses the question of whether both protection through patents and trade secrets can be alternatively applied to the same subject matter. Subsequently, since in the case of patents, the law specifies the subject matter which cannot benefit from such protection, it discusses whether or not it would be appropriate and possible to protect those particular subject matters through trade secrets. The thesis also compares the various defining features of the two institutes. The second part discusses the differences in the acquisition and disposition of patents and trade secrets, focusing on the process of obtaining patents, the scope of protection afforded by a given intellectual property right, and the ways in which these forms of protection are extinguished and revoked. The Act to Regulate the Register of Contracts - interpretation issues

This thesis deals with selected institutes of the Act No. 340/2015 Coll, to Regulate the Register of Contracts (hereinafter as "the Act"). The unifying criterion is their impact on entrepreneurial entities stated in section 2 subsection 1 of the Act. Selected institutes of the Act are contracts and information published in the register of contracts, legal entities by section 2 subsection 1 paragraph n) of the Act, the business secret as an exception of an obligation of publication and an exception of an obligation to published contract by section 3 subsection 2 paragraph q) of the Act. The aim of this thesis is to characterize these institutes in more detail and to find out possible interpreting ambiguities that concern them. It also attemps to offer their solutions with regard to the relevant specialised literature. The thesis is systematically divided into an introduction, four parts and a conclusion. Parts are further subdivided into chapters, subchapters and subchapters's points. 1 Free Access to Information and Public Procurement, Abstract and Keywords Abstract The aim of this thesis is to analyse free access to information of public administration in relation to public contracts, especially in regards with the issue of trade secrets protection in contracts concluded as result of public procurement versus the right to information from public authorities. The thesis focuses on several key aspects of this relationship, the interpretation of which is currently problematic. The thesis examines whether freedom of information legislation applies to all types of contracting authorities, procurements and procurement procedures; whether mandatory disclosures also relate to information on public procurement of the authorities concerned; and whether there may be information provided on request in public procurement. It also focuses on manifestations of restrictions of the right to information in public procurements and manifestations of the right to information in protection of trade secret contained in contracts concluded in public tenders. This diploma thesis deals with the protection of information of the entrepreneur in a particular IT company. Attention was paid first to the area of protection of business secrets, know-how and confidential information towards employees of the company and to its clients and business partners, as well as to the protection of employee's and customer's personal data. Based on an analysis of internal processes and documents, contracts with employees, customers and business partners, shortcomings were identified and recommendations were subsequently proposed in line with valid legislation in the Czech Republic. In conclusion, the economic impacts were assessed not only from the identified shortcomings but also from the introduction of the proposed recommendations.

The bachelor thesis deals with the protection of intellectual property and its eco-nomical aspects. In the theoretical part there is explanation of an intellectual pro-perty, its concept and definitions related to the protection of an intellecual proper-ty protection. The practical part deals with findings about intellectual property in practice with the example of representative company. The conclusion summarizes key concepts with suggestions and recommendations for a concerned company, which might be utilized by the other pontentional companies.

The bachelor thesis deals with the trade secret and its protection. In the theoretical part there is the definition of trade secret and explanation of concepts and contexts that related to it. Then the examples of the protection of trade secret are described. The practical part deals with the protection of trade secret in practice. In conclusion there is suggestion of general recommendations for current and potential holders of trade secrets.

Fogašová, T. Business secret of the entrepreneur and its protection in publishing contracts in public administration. Bachelor thesis. Brno: Mendel University in Brno, 2017. The aim of this work is to highlight the importance of protecting business secret, not only in the business sphere, and to discuss this issue specifically in the context of publishing contracts in public administration. The methods of synthesis, analysis, comparison and description were used in order to complete this thesis and its objectives. The business secrets regulation and its protection were evaluated. An analysis of specific contracts published in the register of contracts, which gave examples of business secrets and the way in which individual entrepreneurs protected it, was also analysed. The thesis also mentions possible ways of quantifying the value of business secrets so that it is possible to assess the sufficiency of business secrets in relation to the very existence of the business. Finally, possible measures have been proposed to improve the protection of business secrets in publishing contracts. After crosschecking of available materials and elaborating this thesis, it was found that the protection of business secrets was not sufficient and should be more detailed in the legal order of the Czech Republic in view of its necessity.

Protection of trade secrets (with a focus on Directive 2016/943) Abstract The subject of this diploma thesis is to assess the protection of trade secrets in the context of Czech legislation with the comparison of the requirements of the Directive on the protection of trade secrets. The diploma thesis is based primarily on the valid legal regulations and Czech case law, which is associated with the regulation of the protection of trade secrets. Individual subjects of competition invest in research and development to gain a competitive edge or maintain their competitiveness. The results of their innovative activities are often subjected to dishonest practices aimed to disrupt or abuse them. The institute of trade secrets is one of the important ways to protect the results of innovative activities. Its importance is confirmed by the adoption of Directive (EU) 2016/943 of the European Parliament and of the Council. The first part of this diploma thesis focuses on the definition of the concept of trade secrets according to the Czech legislation, its comparison with the concept of the Directive and evaluation of their mutual compliance. Journalists and access to information

The aim of this thesis entitled Free access to information from the perspective of journalists is to find out how Czech journalists use the institute of free access to information. The work is based on analysis of specific articles published on the Czech news portals and in the newspapers and also on interviews with prominent Czech journalists, who provided their practical experience from practice. As a result, the thesis charts in which cases and with what success the journalists act according to the law on free access to information. Although the law provides only minimum of exceptions, in which statutory bodies may not provide the information, the actual practice does not respond to. Journalists are often confronted with all sorts of excuses why the office cannot provide the information. The most common reasons for denying the request for information is the protection of personal data, trade secrets and the condition of payment the costs of extremely extensive search. The structure of work corresponds to those reasons - first two sections contain an introduction to the issue of the right to information and freedom of access to information and the next three sections are devoted to the mentioned reasons why some authorities reject the requests of journalists.
